Hi,

I recently received a letter saying my super fund cannot release my FHSS funds because there are "no funds available" in my nominated account. However, I have a valid FHSS determination issued by the ATO confirming I have eligible contributions and an approved maximum release amount.

I suspect the issue may be a name discrepancy. The name on my ATO account appears to be slightly different from the name registered with my super fund (which matches my myGov account).

My questions are:

1. Can a name mismatch between ATO records and a super fund account cause the fund's system to fail to locate the account when processing an FHSS release authority, resulting in them incorrectly reporting that no funds are available?

2. If so, how to update my name with the ATO, to match my myGov account? And once corrected, does the ATO automatically resubmit the release authority to the fund, or does a new request need to be made?

3. Is there any risk that fixing the name mismatch now, after the release authority has already been sent, could cause delays or complications with the existing FHSS application?

Thank you

Hi @TAG2026,

It would be best to contact our super team, as they can look more closely at what’s happening.

If your myGov account is already linked to your ATO Online services, you may be able to update your details online. As you’ll need to call us anyway, if you're having issues with updating things yourself, you can also ask whether your details can be updated during the same call.

Where the super area isn’t able to assist with updating your name, once your FHSS matter has been addressed they can transfer you to the appropriate team to have your details corrected in our system.

Hi @TAG2026 - I checked some details with our FHSS subject matter experts.

Because the FHSS determination is self-assessed, it's your responsibility to ensure the info in the determination is correct before submitting it.

Whether it prefills contributions or you manually enter them - it will accept your submission, as you are signing it as true and correct. If our systems detect an issue with anything in your determination, it will possibility flag it for further checks.

In your case, it sounds like your request was fully approved but then your superfund didn't release the funds to us. One of the causes for this could be the name mismatch between ATO's records and your superfund records.

You should check which records are incorrect and make contact with the appropriate entity to correct your name to match the other.

If the incorrect name is with the Superfund records:

  • you should contact them first to correct this, and
  • only after they have confirmed the update then you can contact us to request a reissue of a new Release Authority.

If the incorrect name is in the ATO records:

  • you should contact us to update this, and
  • request the reissue of a new Release Authority.
