If I remain a foreign resident for tax purposes, working remotely from Australia for a UK company, do they need to make any super contributions?

I plan to visit my partner in Australia, work for a bit less than 6 months, return to the UK for a month and then back to Australia for a 3 month visit without working.

I will maintain a permanent residence, vehicles, employment in the UK to return to.

Would this situation bypass my UK company having to change anything to do with tax and super for the year?

Hi @cfh,

There isn’t a simple yes‑or‑no answer here, because the outcome depends on a few things. Particularly, where the work is performed and your tax residency during that time.

If you perform work while physically in Australia (even as a foreign resident), your UK employer may still be required to meet Australian obligations, including superannuation guarantee, and potentially PAYG withholding and Single Touch Payroll.

If you become an Australian resident for tax purposes, those obligations would apply for the period you work from Australia regardless of where the employer is based.

What ultimately determines your employer’s obligations is whether you perform work while physically in Australia.

Your travel may support foreign‑resident status and limit the obligations to the specific periods you are working in Australia, but it doesn't automatically bypass super or other Australian tax requirements for your UK employer.
