Hi everyone,

I need advice regarding unpaid wages and superannuation.

I worked at [removed by moderator]. The previous entity, [removed by moderator], was liquidated, but the same business continues operating under a same family member(daughter) with different ABN.

I was paid under different ABNs, did not receive payslips for a long period, and only recently found out about the liquidation. I was also told I lost my superannuation due to the company being liquidated and just said I AM SORRY. I’m unsure how liquidation applies if the business continues operating. They also opened a new shop with a different concept shortly after.

I have already raised this with the ATO, but no action has been taken so far.

Fair Work Ombudsman has advised they cannot progress the matter further and suggested small claims court, but legal costs are highly expensive.

Can anyone please advise which government department or process I should contact next to recover unpaid wages and super?

We're the right government agency to report the unpaid super, For the unpaid wages, the Fair Work Ombudsman is responsible for workplace entitlements.


You can also report the companies and their behaviour to us by making a tip-off. It only takes a few minutes, and you can remain anonymous.


For your unpaid super referral, we'll inform you by letter or email if we're able to collect any unpaid super and distribute it to your fund. This process may take time, and not every referral results in collection of unpaid super.


We do take all reports seriously, though privacy laws prevent us from providing updates on the outcome.

I submitted a tip-off a long time ago and have followed up multiple times without any response.

This situation is ongoing and serious. The employer is reportedly using employees’ unpaid super to fund a new store, and most workers are international students working 40–50 hours per week but are too afraid to report it due to visa restrictions.

Please advise how this can be escalated or how I can receive an update, as submitting another tip-off without any follow-up does not seem effective.

You could call our complaints line to ask whether additional evidence would assist. And to seek an update on the unpaid super.


But we can’t provide you with details on the investigation of any tip-off.
