We have lodged 2024 & 2025 financial year tax returns but his BAS are overdue which has PAYGI. There are no tax liability and we have not done any tax credits in the tax returns. Do we still need to pay PAYGI as we cannot vary PAYGI for overdue BAS.

Best to see a tax agent or call ATO

I don't think PAYG instalments can be varied when it's overdue or when tax return is lodged. So there should have been tax credits in the tax return since it's asking for PAYG instalments RAISED, not asking for paid. And lodge the BAS for PAYG instalments. The debt and credits should cancel each other out

"You make your variation when you lodge your activity statement or instalment notice. You must lodge:

  • on or before the day your PAYG instalment is due
  • before you lodge your tax return for the year."
