HI

When an employee has been mutual and validly terminated but is rehired immediately as a casual role to perform the same job under the same job description.

Would the termination payment made as a part of contract termination qualify for the Genuine Redundancy Tax free component or would this be treated as an ETP.

People aren't made redundant, positions are 🤓 Therefore, if it was a genuine redundancy, you couldn't be performing the "same job"? 🤔


Read the Fair Work Ombudsman guidance about what constitutes a genuine redundancy 😉


You cannot already have a prior arrangement to be re-employed.


Read the ATO guidance about the payment and tax differences between genuine/non-genuine redundancy. Your employer should be addressing this issue for you 🤓 Please read the hyperlinks I have provided and discuss this matter with your employer.
