I have a Family Trust established in 2022, with a company trustee..

It has never traded and although all ASIC requirements have been met, I now realise that no nil ATO returns have been lodged since inception. I am winding the company down but unsure what to do about the historic returns. Do I need to lodge returns or can I do an ATO non lodgement advice?

You would need to settle any tax obligations before you close i.e. be up to date with tax lodgment

I don't think it would be a nil return, wouldn't the trust still have the annual ASIC fee of the trustee as an expense?


Also a trust can't do a non-lodgment advice
