Hi I'm in the process of applying for a clearance certificate as selling the property.


There is one question I'm unsure how to answer, as I'd hate to get it wrong and re-do and delay settlement process.


Question: have you lodged a tax return from the last two years?


I have lodged 2023/2024 but haven't gotten around to lodging 2024/2025 as still finalising.


Do I answer yes as a tax return has been lodged in the last two years or no as last financial years hasn't been lodged yet...

  • Yes – if the vendor has lodged both tax returns for the last 2 years for which the due date has passed
  • No – if the vendor has not lodged both their Australian tax returns for the last 2 years, and the due date for lodging returns for those years of income has passed."

So it depends on the due date of your 2024-2025 tax return. If that has passed then answer is no.

If unsure there is an ATO number to call. From link
