In this scenario I am a citizen. (also trained Accountant).
I have received an invoice and a quote from a supplier (without an ABN) including the following statement:
"This organisation is a humanitarian, not-for-profit, tax-exempt, non-government-organisation, and as such is not required to quote or hold any government registrations such as an ABN. This organisation is exempt from, and not registered for GST. The recipient Purchaser must keep this
document with other records relating to the supply for 5 years."
The supplier runs a successful Australian solar installation organisation (definitely turning over more than $150,000) and is trading under an unregistered business name. They are not registered with ACNC or ASIC (as they have stated).
I am wondering whether there is any scenario where this claim (above) is legitimate and legal?
I noticed that a similar question was posted in this community in 2021 - https://community.ato.gov.au/s/question/a0J9s0000001DMl/p00027686 - and am also wondering whether others are seeing this claim popping up on invoices/websites/etc?
