Hello,

I'd like to get a clear answer about CGT exemption rule for the primary family home. My husband and I have rented out 1 bed unit (family home since 2014) from Jun 2022 and decided to sell due to my husband's mobility issue. To get the CGT exemption should we get back to our unit first then sell or we can get CGT exemption while we are renting it?

  • Would be to see a tax agent or ask ATO's private ruling
  • Also it's main residence exemption (MRE), not CGT exemption
  • There shouldn't be any problem with the property being eligible for MRE as it has been your main residence, though I wouldn't know how much MRE to apply e.g. used it for something else before 2014? do both of you have MRE available to apply? is there another main residence property - is it better to use it on that instead? and so on

If you lived in the property from the time you purchased it until June 2022 and neither of you owned any other property that you want to treat as your main residence during that time, then you have up to 6 years from June 2022 to rent it out and still use the main residence exemption. You don't have to move back into it before sale for that to apply. The outcome changes if you didn't move into it as soon as you purchased it, if you used any part of it for business purposes, or had any other properties you owned while you have owned this one, but on the vanilla situation, that's the outcome
