Hello, my husband is on a disability pension, has been for nearly 2 years. I work from home FT, I earn less than $100k/year, I don't get any carer assistance, I just want to seek confirmation that I am eligible to claim the invalid or invalid carer offset. Looking at the criteria I think I am but hoping someone can confirm for me, thanks

Hi @LJS04,

For the invalid and invalid carer tax offset, there are a few key conditions that must be met, including:

  • the person you’re caring for must meet the invalid criteria (based on their condition and support)
  • they must be dependent on you for financial support
  • your adjusted taxable income must be below the relevant threshold
  • you must have provided care and support, not just lived together.

Receiving a disability pension doesn’t automatically mean the criteria for the offset are met – the test is based on the specific eligibility rules for the offset, not just the payment they receive.

Because this depends on the full details (your income, their circumstances, and level of dependency), it’s best to use the offset eligibility guidance to check eligibility.
