Hi, I called the ATO to ask if I could request a release of my First Home Super Saver (FHSS) after signing a contract (before settlement is reached). I was told I could try and see what happens.

I requested for a release 2 days after signing a contract in March 2026 and have been waiting for a release (I had a determination prior to signing). The request was pending and today on rechecking, the request for release has disappeared.

As it is now after settlement, am I able to still get my FHSS contributions released? I'm not sure how a request to get the release could disappear.

It took way longer than 21 days and the FHSS was not released, was there another step I was not aware of?

Hi @ten,

It depends. This situation needs to be checked against the FHSS timing rules and your specific request status.

For FHSS, there are strict rules about when you:

  • request the release
  • sign your contract.

If a release request isn’t completed correctly or within the required timeframe, it can affect whether the amount can be paid.

The request disappearing from your account doesn’t necessarily mean it’s been processed. It could indicate:

  • the request is still being processed
  • there was an issue with the request
  • it wasn’t completed successfully.

You’ll need to phone our super line so we can look at your FHSS record directly, including:

  • whether the release was issued to your fund
  • why the request is no longer showing
  • whether you’re still eligible to receive the amount.
