I have been informed by the professionals handling the voluntary liquidation of my company that the ATO has not responded to their request for a decision on a tax ruling in order to wind up the company. This has been over 3 years and apparently nothing heard. I would like to hear from anyone about the possibility of this happening. I know they are busy, but 3 years seems a long time to wait for any sort of response, especially when the ATO website specifically states the responses, which appear to be very reasonable.

However, in situations like this - delays can occur if we don't have all the documents and information required to support the request. When this happens, it can impact the timeframe for a decision to be made.


Your first step is to ask your liquidator to contact us directly for an update. This will help confirm:

  • the current status of the request, and
  • whether any additional info is needed to progress it.

The problem is that the liquidator is not responding. I have tried to contact you but I dont have a portal account. Can you give me an email contact to request?

If your insolvency practitioner isn’t responding, you can still contact us directly, although there may be limitations to what we can discuss. You'll need to phone us for this. It can't be done by email.


When you phone, explain your situation clearly, and ask for the status of your account, any outstanding obligations, and whether correspondence has been sent to your practitioner.


If the issue continues, you can ask us to escalate your matter or lodge a complaint.


At the same time, if you have concerns about the practitioner. You can raise these through:

·      AFSA (for bankruptcy trustees), or

·      ASIC (for company liquidators/administrators).


Keep detailed records of all contact attempts with both the practitioner and us. This will support any escalation and help you progress the matter more effectively.
