I think you would need to wait and see. I believe the proposed tax reforms on negative gearing that have passed would mean you quarantine (no negative gearing) the losses, starting 1 July 2027 (definitely get a tax agent/lawyer to double check the legislation). I think there was news about adding more (so another bill) to specifically address divorcees, widow/widowers issues when it comes to negative gearing but don't have a guarantee it applies for your situation.
