Hello,

I have purchased two houses at the same time around 3 months ago.

I started living in one house-1 and renovated other house -2.


house -2 was never rented and I sold house -2 with a good profit.


do I need to pay capital gains tax on that or I can exempt from capital gains tax by showing it as primary place of residence?


and if I claim exemption this time, when will I be eligible to claim exemption again for primary place of residence.

Hello there @Ajayyadavnet,


No. Eligibility for main residence exemption is based on you being an Australian resident and the home must:

  • have been the home of you, your partner and other dependants for the whole period you have owned it
  • have not been used to produce income (Including buying the property to renovate and flip it)
  • is on land of 2 hectares or less.


Generally, you can't treat more than 1 home as a primary residence at a time either.


You will be able to offset some of your gains using the costs of improving, maintaining and selling the home.
