A fibreglass pool builder/installer wants to hire me as a “contractor@ to sell his installation services on a 100% commission basis ie. I follow up all sales leads, meet prospective customers at their homes, drive to see them onsite using my vehicle etc. I will only be paid upon a customer signing up for a pool to be installed. As a Sales Rep for this business is this a “sham contract”? Am I really an ‘employee’ not a ‘contractor’ & thus entitled to super, sick leave etc? Don’t wish to be scammed as never worked commission only job? Unsure whether this job is really covered by an award eg. Commercial Sales Rep?

Hi there @Pool
We can certainly help with determining if you're a contractor or employee and eligible for super. The links on our website tell you more about about this to help you assess your situation. As for whether it's (to use your words) a 'sham contract', you would need to contact Fair Work.
