Hi community, currently doing share trading (not investing) as a sole trader, and planning to transition to a company structure. With current portfolio being $100k (market value), and a mix of shares that are held both more than 1 year and less than 1 year. In order to minimise tax impact and related transaction cost while complying with ATO rules, can I : 1. Sell off my entire portfolio (account under my own name) and buy back (using account set up under the business name)on the market within same week? OR 2. I need to do a straight amount to account off market share transfer?


And what are the tax implications on the sole trader part (e.g. realised FYTD gains)?

Ask your broker which is cheaper.


Tax would be the same because off-market transfer deemed to be at market value.
