Hi, I submitted a Notification of a deceased person to the ATO on 15 July 2023. I subsequently followed up with the ATO on 28 August 2023 if they received all of the correct documentation lodged through Australia Post, which the ATO advised they have. It has now been 45 days since I lodged the Notification. My question is will I be fined if I cannot submit my mother's tax return by the closing date of 31 October 2023 if I do not receive notification by then? Thank you for your help.

We are aware that meeting tax obligations for deceased individuals can be a bit of a process and sometimes even complex. If by chance a penalty was placed on the account you could just ask for it to be remitted as you would most likely have reason for it not being lodged on time. Some estates can take years to just figure out who would lodge the obligations so we are usually happy to help you if you can't lodge by the normal due date.

Am I able to lodge her tax return if I have her Payment Summary? (which I do) I know you have received all the appropriate documentation. I am at a loss as to why I have to wait to receive from the ATO notification that you have accepted my mother's death!
