I am writing to inquire about the process for claiming a refund on tax deductions that were incorrectly taken due to an error in my tax status. It has come to my attention that my tax status was incorrectly listed as a non-resident when, in fact, I am an Australian resident living in Australia as a PhD student.

The incorrect tax status has now been updated with my employer and will be effective from 10/11/2023. However, I am concerned about the marginal tax that has been withheld from my income prior to this date.

Could you please advise on the steps I need to take to claim a refund for the overpaid tax? Is there specific documentation I should prepare or forms I need to fill out to facilitate this process?

The only way I know of getting back "overpaid tax" is to lodge a tax return. You won't be able to do this until after June 30 2024 as you only lodge one a year. If you lodged a 2023 tax return as a tax resident then any "overpaid tax" before June 30 2023 will have been refunded.

Many years ago I had a similar sort of issue with overpaid tax, and I approached my empoyer's personal area and they were able to reduce the tax withheld from future pay to balance it out, and it worked out well in the end.


Approach your employer and see what they say, you have nothing to loose and if they are willing to do it then you do not have to wait till you lodge your income tax return to get your funds.
