Hi, my husband and I are from Australia. My husband has been paying tax for years, I am a stay at home mother so have not paid tax for some time. We own a house which we built last year. It is or only home we own, however we had to come to NZ for awhile maybe a year for family reasons. We do not own anything here and it’s only temporary. Do we need to pay Foreign resident capital gains withholding clearance on our house we are selling to get the certificate.

I understand that you've built your home and now may need to consider selling it. When it comes to FRGCW, it applies to real property disposals where the contract price is $750,000 or more. If you're an Australian resident vendor, you can apply for the clearance certificate. This will ensure the purchaser does not withhold the 12.5% at settlement.
