Hi, i am australian born and resident but moved to thailand in May 2023, and are on a non resident visa here, and my australian company asked me could i work 2 days on casual contract, to which i have done since may 2023.

Ive now applied for a fulltime job for another australian based company to work remotely here, same senario as above being paid into australian bank account, but they say that i need to be in australia physically for more than half the financial year than overseas for tax purposes, i cannot find anywhere on the ATO website this is the case, ive also read many questions here and this being in australia more than half the year is not mentioned

i completed the residency for tax tool and it indicated im not a resident for tax, but the tax doesnt matter as yet its the time they say the ATO requires me to be in australia?

can you assist so i can make a decision what to do please, thanks

Hi @mikeydawson,


Did your new employer explain why they think there's tax implications to you being outside of Australia? If you're not a tax resident of Australia then your employer won't need to withhold tax or pay super. So realistically, there are no tax implications for them.


Since you have an Australian bank account you may still need to lodge a tax return in Australia due to interest.
