You are asking about a clause in an industrial instrument? The ATO cannot help you with employment matters: that's the role of the Fair Work Ombudsman.
Pay and conditions are defined in Modern Awards, Agreements or policies. You don't mention if you are paying as per the Award. If you are, you simply look up the Award: in your case, probably the MA000020 Building and Construction General On-Site Award 2020. You are probably referring to Clause 26.4 Distant Work Payment.
