My partner submitted a tax return via a tax agent. The ATO has paid the refund into an incorrect account. To date teh ATO place the blame on the tax agent and the vice versa.

The tax agent has submitted the return with the incorrect bank account details.


On the tax return my partner was emailed to sign she noticed an incorrect bank account. The incorrect account was not an account we ever had in our name. She had the tax agent correct the account number and on the form she signed it was correct.


The ATO are stating the tax agent did not update an internal system and therefore it was paid into an incorrect account. We have not been able to gain any information as to what account it was paid into.


We have requested our tax agent rectifies the issue with the ATO and spoken to the ATO direct but we are no closer to getting any information as to where the refund is / will be paid. This issue has now been ongoing for about 10 weeks now and is well outside the timeframes the ATO website quote for rectification.


On our ATO portal there is no mention this issue or an ongoing investigation.


Can anyone help us with our options and guide us in the direction of where we formalise a compliant / investigation.

That must be very frustrating :(


The best way to resolve this depends on if the refund was paid into the tax agents bank account, or an unknown third-party account.


If it went to the tax agent, you need to get the refund from them.


For an unknown account, we can try to retrieve the funds, but it can take a while depending on when information is received from third parties such as banks.


You mentioned you want to lodge a complaint. A resolver will then be assigned and tell you what to expect.


I hope you get it sorted soon.

Hello @TonyATO


It has been confirmed this money has been paid to an unknown third party. And the money has been with that third party for about 10weeks.


It has also been confirmed the accountant put the wrong bank details on the form.


Can you please tell me what would happen if the ATO does not retrieve money from the third party's bank (e.g. they have spent it and the bank is unable to recover, therefore does not repay the ATO). Do we lose the refund?
