Hi,


I'm 55 and my wife is 66. If we divorce, and I were to give her say, $200,000 from my super in the divorce settlement, would she be liable for tax on it? If so, how much? My wife currently has no super and no super fund. Would there be any restrictions on what she could do with the money, or could it just be put into her bank account, to do with as he wishes? Thank you for any help.

Should be no tax, but best to talk to your lawyer about this.

Thanks. Divorce lawyer can't advise - tax not their area. Maybe I need to talk to an accountant/financial adviser. I've asked elsewhere online, and was told something about 20% tax being payable. But that was on Whirlpool, and who knows if they know what they're talking about.
