I have given the contractor the super form multiple times however he is refusing to sign or return the form. I have tried to create him a membership in the super company our firm uses as however I need his TFN to do this. He wil not provide that either.

How do I meet our obligations to pay his super - this has been going on for 4 months now

That sounds like a bad situation. It sounds strange that he isn't willing to provide super or TFN details.

As an employer your obligation is to provide your employee with a standard choice form within 30days of starting employment with you. If this occurred but they did not complete the standard choice form or elect the employer default fund, you could request their stapled super fund details from us. You can view where to pay super for your employees from here.


However, without their TFN you may not have enough information to do so. If this is the case, you'll need to complete the SGC statement and put as much information as you have for them on the statement and send this to us together with the SG payment.
