EBA Clause: Broken shift

(i) Outside the spead of nine hours from the time of commencing work will be paid at:

(A) Time and a half the ordinary rate of pay for the first three hours (Monday to Friday shifts only)

(B) Time and three-quarters the ordinary rate of pay for the first three hours (Saturday and Sunday shifts)

(ii) Outside the spead of twelve hours from the time of commencing work will be paid at double time the ordinary rate of pay.

Perm Part Time employee, Roster: 7 hrs on Monday (8:00 - 15:30)

Taking a broken shift 6hrs (16:30 - 23:00)

Be paid by P1 (Ordinary Rate x 9hrs) + P2 (Ordinary Rate x 1.5 x 3hrs) + P3 (Ordinary Rate x 2 x 1hr)

My question is how to report. All P2 & P3 go to Overtime, or Ordinary parts in P2 & P3 are still OTE, only higher rate parts go to Overtime.

In other words, these should be reported by OTE (9hrs in P1) & OT (P2 & P3), or OTE (13hrs in P1, P2 & P3) & OT (Ordinary Rate x 0.5 x 3hrs in P2 & Ordinary Rate x 1 x 1hr in P3).

Or there is other Code to report except OTE, OT. Thanks!

Hiya @evan.dong 👋

How is overtime defined in the EBA/underpinning award? It's usually in 3 parts, such as in excess of # of ordinary hours per week; and outside the span of hours ??am to ?? pm per day; and more than # hours per day.

That detail is required to confirm if P2 and P3 are overtime or a penalty rate on ordinary hours.

Is there a specific clause for PT hours?

As with all things payroll, it's based upon the industrial instruments, not a common rule!
