My husband is the Principal of our Family Trust. He is also the Director of the Corporate Trustee company. The company has a registered business name with ABN, not registered for GST. If I was to secure a contract typing position:

  • can I operate through the Trust and Company and provide the employer with the business name and its ABN;
  • do I have to provide the employer with an ABN registered to me;
  • does my husband have to employ me through the Company;
  • do I have to be an employee of the Company if the employer is paying me super.

It all depends, if a trust is set to run a business, it should have a trust deed. This’ll set out what can or can’t be done and who the beneficiaries of any income would be. In this case it’ll be best if you got in touch with our technical area, they’ll be able to take all the info about your situation including the info from the deed and provide you accurate advice.
