Hi, l am a casual FIFO worker l work 12 hrs day for the duration of job, l am paid a flat rate for all hours worked. Weeks totaling 84 hrs, my employer is saying that 38 hrs are ordinary time and remaining hours are listed as over time or other time and not paying super on these hours. l am not on an award or get any overtime pay or any other allowances just a flat rate for the duration of the job.

Can anyone explain this to me as l can't find out any info on workers not on an award working these hours and their super payments.

Some companies do pay super on all hours and others are using this method to not pay it.

Hey @FIFO-Worker,


It depends on either the award or the agreement you have with your employer. Generally super is only paid on ordinary time earnings. If your agreement states that your ordinary hours of work per week is 38 hours, then anything worked over this is overtime and super won't be paid. Being overtime penalty rates should apply. Again, this depends on your agreement.


However, if you work overtime where the ordinary hours aren't stated in your award then super will be payable on the 84 hours your work.

Thanks very much for your reply, no there is no award or agreement just a flat rate of pay for all hours worked, you are paid the same rate no matter how many hours you work with no overtime penalty rates or any other extras payments.

I am in an almost identical situation, my employer has flatly refused to look at the ATO website where it states super is to be paid on all hours worked. Where do I go from here?
