Hi there, I have a quick question about contributing to my superannuation whilst living & working overseas.


As an Australian living in Melbourne in previous years, I have made Non-concessional contributions into my Superannuation account and then lodged a Notice of Intent to Claim Form for a portion to roll-over and maximise my Concessional Contributions up to the maximum of $27.5k. I then claimed this amount on my tax return using the Notice of Intent to Claim Form.


Whilst I am not earning Australian employment income, I am not getting any funds into the Concessional Contributions, so can I make Non-Concessional Contributions and then roll them over into Concessional contributions with a Notice of Intent to Claim Form. I have currently hit my non-concessional contribution cap, so this process is perfectly fine if I am an Australian resident earning employment income in Australia, but I want to check whether it is ok whilst I’m a non-resident.


If I am generating a tax loss in any year, I don’t get any tax claim on the Notice of Intent to Claim amount as I can’t use it to extend a Tax Loss, but I think that I am still able to make the contribution onto my Super via the Non-concessional to Concessional route. Is this correct?

I can't seem to find that similar post either.


No worries I can help! The original answer is correct, you can still contribute to your superfund, even when you're a non-resident.


Have a read through understanding concessional and non concessional contributions as well as personal contributions so you can understand what type of contributions you can make each year without paying additional tax and what deductions on personal contributions you can claim.


If you're living overseas and making the contributions yourself, it’s also a smart move to stay in touch with your super fund just to make sure everything runs smoothly.

Hi @Aussie69,


It is still fine for you to contribute to your Australian super while being a non-resident. If eligible, you can still claim a tax deduction.

Hi WendyATO, thanks for your response and links which were really helpful, and from which I understand the following :-

  • I can make non-concessional contributions whilst living overseas.
  • I can roll these over from Non-concessional to Concessional using the Notice of Intent to claim form, and claim the contributions as a tax deduction.


So my final questions are :-

  1. Can I still make the non-Concessional and roll it over to a Concessional even if I have maxed out my Non-concessional cap and used the bring forward rule up to the $330k?
  2. Can I still do this if my Superannuation balance is above the General Transfer Balance Cap?


From my research on the ATO website, I believe the answer is yes to both these questions as the contribution ultimately becomes a Concessional contribution, but would appreciate your confirmation.
