My husband and I are moving overseas and have learnt the UK does not have a Superannuation equivalent. With this in mind, whilst living over in the UK, can we contribute to our Australian Superannuation fund and is there a limit to which we can contribute YOY?

If considering making contributions as a non-resident - the normal rules apply. For example, to make a personal contribution, you must have provided your TFN to the trustee. If you are wishing to claim a tax deduction for personal contributions, you need to still lodge a tax return and have assessable income to offset the deduction. As a non-resident, you may not have any assessable income - so worthwhile checking your situation with a registered tax agent.


The normal contributions caps also apply.

While these are the general rules, it is worthwhile checking with your individual super fund that contributions can still be made. However, if you have an SMSF - this could have greater limitations in making a contributions including the active member test.

If you have an SMSF, it is worthwhile to check with your administrator, registered tax agent or financial planner to understand implications for your SMSF.
