1. Can SMSF corpus be invested in Mutual Funds and Equity Shares in emerging and developed countries.

2. Can the Trustee invest in his/her own name (by including a declaration of Trust) or investment has to be in the name of SMSF only.

3. If the trustee is allowed to invest SMSF corpus in his own name, then will the tax deducted in India be allowed to off-set against tax liability of SMSF in Australia.

We have got the approvals from Indian regulators to invest SMSF Funds in Mutual Funds and Securities. The investments can be done in the name of Corporate Trustee (example ABC Pty Ltd). However, the regulators are not permitting to add suffix “ÄTF ABC Super Fund” to the Corporate Trustee name as the ACN is registered in the name of ABC Pty Ltd. Internally, to ensure that only the Super Funds are invested through the Corporate Trustee, we have maintained proper process, accounting records and accurate audit trial very strictly.

My query – Given the above circumstances, can an SMSF invest in the Overseas Mutual Funds in the name of Corporate Trustee only i.e., without adding the suffix “ÄTF SMSF Fund”.
