Hi. I work for an employer that has an office, but the office is 3 hrs commute each way from my house, so I work at home.

The ATO website states that one condition for this is that;

"It was necessary for you to work from home because your employer doesn't provide you with an alternative place to work from"

Can I claim Occupancy expenses as my employer does not have an office where I live?

No - you have chosen not to use the office provided by employer.

@Bruce4Tax would this be the case for employers who have downsized their office to accommodate hybrid working and no longer have a desk available for all staff i.e. you have to book a desk to work in the office and there isn’t availability for all staff therefore required to work from home 3 days a week, sometimes more. Thanks.
