When does the ATO need to be advised of the resignation of a Director? I have a number of Company's that have had a Director removed. Some of these entities have an ABN, others only have an ACN, and a handful of them are foreign entities that hold an Australian TFN.

I note Form NAT 2943 'Change of Registration Details' can be used to update details for entities with an ABN, however:

1) It does not have a section to advise of removal of a Director, only the addition of a Director; and

2) If an entity does not have an ABN, do we still have to advise the ATO of this change, and if so, how do we go about it?

Thank you in advance for your assistance. Updating ASIC is so much simpler!!

I would call the ATO and ask, but I haven't been able to get through to the ATO via phone for months.

When filling out the change of registration form you can attach a letter requesting the removal of retired directors. If the entity doesn't have an ABN then you'll need to contact ASIC and get them to update the registration details of the ACN. For an entity that holds a TFN they will need to make sure that the authorised contacts are also updated and the previous director removed.

If the entity doesn't have an ABN then you'll need to contact ASIC and get them to update the registration details of the ACN. For an entity that holds a TFN they will need to make sure that the authorised contacts are also updated and the previous director removed.
