We have a few employees that have banked overtime hours that are exempt from Super Guarantee as Time of in Lieu (TOIL). ie banked 4 hours overtime at 1.5 = 6hrs TOIL, these overtime hours are above their normal 38hrs and are exempt from Super Guarantee. However when setting up TOIL in XERO as a leave item it doesn't allow the option for the "exempt from Super Guarantee" to be marked/ticked.

I have queried this with XERO to request this option to be enable but they say you have to pay the Super Guarantee.


Clarification required please, my understanding is this overtime is banked being exempt from Super Guarantee so we wouldn't have to pay super on the TOIL when paying the employee.

You are correct, TOIL is exempt = banked overtime = not ordinary time earnings = no SG, report this to the manufacturer!
