I'm an Australian (dual NZ citizen) living in New Zealand. I'm non AU tax resident as I have not lived in Australia for many years. I have an AU student loan and have been filing tax returns every year with the ATO.


Last year I used the ATO tax tool and was told because my income fell below the $12K approx I should file a non lodgement (as opposed to a tax return). I did so using my MyGov account portal.


This financial year 2024 unlike previous years I was not emailed informing me I had to submit a return. Nor is there the option to submit a return or non lodgement to the ATOI using my MyGov portal.


This left me confused so I called the ATO to be told I no longer needed to submit a return/lodgement and could pay off my loan when I was ready. It wasn't made clear why this was?


Can someone please help me understand what has changed? Is it because I submitted a non lodgement last year 2023? Does the non lodgement follow over to ensuing financial years or is there an error/issue that needs to be addressed?


Any advice would be appreciated as I'm not sure where I stand at the moment.

It must be great having dual citizenship!

When you fill out your non lodgment advice, there is a question about lodging for future years.

If you select NO, then you're telling us that you don't need to lodge anymore.


On a side note, though, even if your income was below 12k, If you paid any tax then you would need to lodge a return.

Even if you have lodged a non lodgment advice, you can always lodge a return for that year.

Many thanks for the reply. Being dual has its moments but can be challenging when it comes to differences in taxation. In New Zealand, generally you don't need to submit a return or anything else, do anything if you have nothing to declare as an individual.


So if I'm reading this correctly if I did not pay any tax in NZ or AU(which was the case this year) and I submitted a non lodgement last year (which I did) then I don't have to do anything this year 2024 or thereafter until I earn an income that is taxable in either NZ or AU at which point I would need to submit a return?

Hi @KiwiAu


The only way to not have to lodge is if you select NO to the question of lodging future tax returns.


So, let's say you lodged a non-lodgment advice for 2023.

The question that asks 'do you still need to lodge for future years' you select YES, then you'll still need to lodge.

If you were to select NO then you don't need to lodge from 2024 onwards.


Anything to do with NZ you'll need to get in touch with their relevant authority about.
