Hi,


I noticed my employer has listed quite a large sum as salary sacrifice after making unauthorised deductions from my final pay after leaving the company. I have already contacted fair work in regards to the unauthorised deductions but I don't understand why it is listed as salary sacrifice and what consequences this might have for me as I do not know much about the taxes related to salary sacrifices, illegitimate or not.


Can someone please provide some guidance?

Salary sacrifice arrangements are mutual agreements between the employer and employee. If you didn't agree to it, it shouldn't even exist. Where was the money sacrificed: to your super fund or some other benefit? You'll need to know that!


Additionally, what was sacrificed from your final pay? Only salary and wages can be salary sacrificed, not unused leave on termination or ETPs.


If they did salary sacifice a payment that would otherwise have been paid to you, the PAYG withholding is reduced, as the "taxable payment" is reduced by the salary sacrifice. It will be reported on your Income Statement as Salary Sacrifice to either Superannuation or Other employee benefits. Also, there may be RESC reported for the amount that may have been sacrificed to superannuation or RFBA reported for the GROSSED UP amount that may have been sacrificed to other employee benefits. Not all "other employee benefits" will be RFBA.


RESC and RFBA are assessed as income for a variety of government benefits.
