My partner and I have been living separately for three years but we are still legally married. They are saying that the answer to the ATO "Have you had a spouse" question should be "no".

Could someone please confirm from the ATO perspective, are we each other's spouse for tax purposes?

ATO answer:

"A spouse is anyone you've lived with in a genuine domestic relationship at any point during the year".

Separated means no spouse.
