I am a Filipino on a student visa in Australia, working part-time at an engineering firm. My visa expires on March 3, 2025. I am currently applying for the 189/190 visa and have submitted my EOI/ROI in Victoria, but I have not yet been invited to apply. If I don't get an invitation, I may need to return to the Philippines and wait there for the invitation to apply for the visa before returning to Australia.


My questions are:


1. If I return to the Philippines, can I work remotely for my Australian employer and change my tax status to non-resident, even without a valid Australian visa?


2. What will happen to my superannuation if I return to the Philippines? I understand my employer will not continue contributions, but can I keep my super account open? Would it be better to keep it until I return with permanent residency, or should I withdraw it?


3. Regarding my tax return, can I file it earlier for the period of July 2024 to March 2025 when I am considered a resident for tax purposes? What will happen for the remaining months when I will be considered a non-resident and subject to a different tax rate?

That's up to you. If you withdraw it as a DASP, it'll be subject to tax depending on your current visa. If you leave it here, it'll stay open for a certain amount of time depending on the balance and when you come back.

Otherwise, it could get sent to us, where we we'd hold it for you. ๐Ÿ’ฐ


3. Regarding my tax return, can I file it earlier for the period of July 2024 to March 2025 when I am considered a resident for tax purposes? What will happen for the remaining months when I will be considered a non-resident and subject to a different tax rate?

Yes, you can lodge it earlier. You won't need to declare income as a foreign resident here in Australia.


If you get your pay paid into an Australian bank account. You might want to give the bank your overseas address, so they don't withhold too much tax on any interest earnt. ๐Ÿ‘Œ
