Hi,


We are paying out residual bonus payments to a former employee.


A few questions:

  • The bonuses are normally paid inclusive of super. As they are an ex-employee is super still required to be paid on the bonus.
  • If the former employee would like to salary sacrifice additional super from the bonus, is that possible?

Interesting question.


Assuming, these would be backpay for ordinary time earnings or salary and wages and not part of any termination payment. So, they would be considered under the same rules as usual. 👌


Whether an employee still works for you or not, doesn't stop prior obligations already in place.

The salary sacrifices of super would be up to you. 😀
