I own a primary residence with my brother (60%- 40%) valued at $1,000,000 in NSW. If I purchase the remaining 40% off my brother, do I have to pay full stamp duty on $1,000,000 (stamp duty approx. $40k) or just on the 40% of the property's value being transferred - $400,000 (stamp duty approx. $15k)? Thanks

You will need to contact your state authority that administers stamp duty on land transfers. This is a state tax, nothing to do with the Australian Taxation Office.

I doubt you will get an authoritative answer through this forum.
