I am a Psychologist contracting for a company, using my sole trader ABN. The clients pay the company and I invoice the company fortnightly for all the clients I have seen (50% of fee previously then got changed to a set fee per session). I am expected to see 5 clients per day, and don’t get paid unless I see a client. I am also only allowed to take 4 weeks leave per year. 100% of my income comes from this company. I have to see the client myself (can’t subcontract the work), and am strongly encouraged to attend team meetings and lunches. Am I supposed to be getting paid super, and if so, is that additional to my session fee (or included in it)? I’ve been working here for 3 years.

The info you've provided indicates that you have more traits as an employee than a contractor. An employer is required to pay a percentage or your ordinary time earnings into your super fund.

Thank you Kylie, I thought so too. Regardless, I have left that work role and will need to follow this up now with them but can I confirm what you mean by “a percentage”: if I have already been paid fortnightly for the clients I have seen, is the superannuation in ADDITION to this that the employer now needs to pay to my super fund, or did it need to come out of my earnings (which have already been paid to me and hence now I need to make the contribution myself….)?

Super guarantee comes from the employer's pocket and not your earnings.
