I am currently on a 485 visa (with OVHC medical insurance) and have also applied for a 190 visa and have an interim Medicare card. I would like to know how we can be exempted from paying the Medicare Levy Surcharge (MLS) and meet the insurance condition on our 485 visa.


From reading this forum so far, I understand that OVHC insurance alone would not be enough to be exempt from the MLS. However, we are concerned that by switching to residents' private insurance, we may violate the OVHC insurance condition in our 485 visa.


We are both australian resident for tax purposes and qualify to pay MLS in 2024-2025 financial year.

Hi @pinkm


To be exempt from MLS if you make above the threshold, you and any dependants if applicable including a spouse would need to have the appropriate level of private patient hospital cover.


Its best to speak with your insurer for their options that cover MLS and any visa conditions you have.
