I am reaching out to seek guidance regarding the tax matters of my late brother. He's an international student in Perth. He passed away on January 4, 2025, here in the Philippines, and I need assistance in processing his taxes.

Specifically, I would like to inquire about the following:

  1. How can I request letters of administration as a legal personal representative?
  2. Since I am currently in the Philippines, is it necessary for me to travel to Australia to manage his tax return, or are there alternative processes I can follow remotely?

Your advice and guidance on these matters would be greatly appreciated. I look forward to your response. Thank you.

  1. You may need to consult a solicitor (or a court registry) in the Philippines. If there is no Will, the solicitor or registry staff may take you through the process of making an application for a grant of letters of administration. Depending on the value of the assets of your brother located in Australia, you may need two grants or "resealing", one each in both the Philippines and in Western Australia. To some extent, in the case of bank accounts, their policies can differ from bank to bank.
  2. If your brother's taxable income for the six months ending January 4 2025 is less than $18200, which is the tax threshold (if he was resident in Australia for tax purposes), then I think you do not need to complete a tax return for the date of death return for the period running 1 July 2024 - 4 January 2025.
  3. I hope I am telling you the right advice ? I think you need to consult someone face to face in the Philippines who knows what they are doing.

Your first steps (if any tax returns are needed) to file tax returns without leaving the Philippines is to obtain your late brother's tax file number, also request a second tax file number for the deceased estate, also download blank tax return forms for individuals and for trusts (for the year ending 2025 June 30). These forms should become available for download in mid June 2025.
