House C was purchased in Nov 1999 as owner occupied house, lived there until Jan 2000. Then been renting out since then to 2023, there might be vacancy period no longer than two years. Moved back to house C in November 2023 as owner occupied, sold in February 2025, is CGT exemption 6 years rule apply since it has become owner occupied from Nov 2023? Also, how many times can one person use the CGT 6 years exemption rule ? It’s per house related , yes ? I guess as long as you can’t claim CGT 6 years exemption 2 times in the same tax year?

Hi,

if you have been an Australian tax resident all this time and did not own any other property you can use the 6 year rule in your case. ATO Guidance
