Hi! I'm currently a master's student in Australia with a year left to complete my studies. I'm interested in starting an online clothing business, which I intend to run as a sole proprietorship. However, I'm confused whether I am eligible to obtain an ABN with the visa I currently have (Student Visa Sub Class 500). Hope someone can help me clarify this issue.

Thank you!

As an international student on a Student Visa (Subclass 500), you may be eligible to apply for an Australian Business Number (ABN) if your business activities align with the conditions of your visa. The primary concern is whether your business would comply with the work restrictions imposed on student visa holders, which generally limit you to 48 hours of work per fortnight during the academic term. Running a sole proprietorship could be considered "work," and if it exceeds this limit, it may breach your visa conditions. Additionally, the Australian Business Register (ABR) assesses whether your business qualifies as a legitimate enterprise rather than a hobby. To ensure compliance, it is recommended that you consult the Department of Home Affairs or a migration expert before proceeding with an ABN application.
