Hi,


If I hire an independent contractor for labour work, and they invoice via a company, do we have to pay them super?


If this individual/company does other work on the side also, and not reliant on my jobs, would we still have to pay super in this regards or would him, the company be?

The ATO has quite explicit guidance about SG obligations for independent contractors. When you say "company" do you mean they use an ABN? That's covered in the guidance too.

Yes they have an ABN also. But they are trading through a company, and he is performing the work himself. Couldn't find anything specific online regarding my initial questions.
