Hey All,

We did a knock Down and Rebuild for our home . We built a duplex so one can be our home and the other will be investment property. during KDR We rented a house.


Once the duplex was ready, we continued staying in the rented house. We rented both unit to tenants (only has been less than a year).


Will our own house considered an investment property and CGT will apply because I rented once it was ready ? Or because we used to live in it before KDR and we don't have other property no CGT will apply?

(I know that second unit will be considered investment property, I am asking for my unit where we will live one day) .

CGT will apply. Link explains what you must do if you demolish and rebuild to continue to regard the dwelling as your main residence.

Building or renovating your home | Australian Taxation Office

"You need to move into the dwelling as soon as practicable after it is finished and continue to use it as your main residence for at least 3 months."
