Hi everyone,

I’m looking for advice on my tax situation after transitioning from a Working Holiday Visa (WHV) to a Temporary Skill Shortage (TSS) Visa. I’ve been in Australia for 7 months, working in the same employer from day 1, and I reached the second tax bracket ($45,001) in my 4th month. My employer and financial team are aware of my visa change, but I want to make sure I’m handling everything correctly on my end.

I’ve heard that I might need to fill out a Withholding Declaration (NAT 3093) to update my residency status for tax purposes, but I’m unsure if this applies to my case and how to fill it out properly.

Can anyone confirm:

  1. Do I need to submit a Withholding Declaration to update my tax residency with my employer?
  2. Will my tax rate change automatically now that I’m no longer on a WHV, or do I need to take further action?
  3. Anything else I should be doing now to ensure my tax is being calculated correctly?

I’d appreciate any insights from anyone who’s gone through this transition or has experience with tax obligations for visa holders. Thanks!

Hiya @imkrzysiek 👋

Well done for your proactive research 👏 Answers as follows:

  1. Yes, your circumstances have changed (Eg: TFN Declaration Q8), so you are required to complete a Withholding Declaration and provide it to your employer
  2. Your tax rate is determined by the responses on the Withholding Declaration, such as your tax residency
  3. ATO guidance provides an overview of how tax is determined and provides tools to check.
