I got below email from my accountant. The fact that I am responsible to pay for audit fee by ATO, even if there are no adjustments, sounds incorrect. Can someone please confirm if what the accountant mentions below is accurate? Much appreciated.

Dear Nitin,

Re: Audit Shield Service for Nitin Pandey

Are you aware that your previously lodged returns can be audited by the Australian Taxation Office (ATO) at any time, even if those lodgements are accurate?

The ATO continues to review a vast number of returns and in many cases no adjustments are required. However even if no adjustments are required, you could still be left with considerable professional fees as a result, and this is why we offer the Audit Shield service.

Payment is tax deductible should you choose to participate, and all previously lodged returns are protected automatically, regardless of who prepared them.

All of our clients can take advantage of the Audit Shield service. Specific levels of cover are available for individuals, businesses and SMSFs.

We emphasise that there is no compulsion to participate. However, we consider this service to be a valuable tool in reducing the uncertainty of unexpected fees.

the fee is for insurance on accounting fees. If you are audited by the ATO and your accountant spends time preparing and collating and they send you an invoice, then your insurance will pay the accounting fee

Never mind. ChatGPT dumbed it down for me :)

Your accountant's email is about Audit Shield insurance, which is an optional service offered by many accounting firms. Here’s a breakdown of what’s happening:

1. Are You Required to Pay an Audit Fee to the ATO?

No, the ATO does not charge you a fee for being audited. If they audit your tax returns and find no issues, there are no penalties or additional taxes to pay.

2. Why Would You Incur Costs?

Even if the ATO doesn’t adjust your tax return, the process of being audited requires professional time. Your accountant might need to:

  • Provide records and documentation.
  • Answer ATO queries.
  • Prepare reports.
  • Communicate with the ATO on your behalf.

These professional services aren't free, so your accountant might charge you for their time during an audit.

3. What Is Audit Shield?

Audit Shield is not a fee you must pay to the ATO. Instead, it’s insurance that covers the costs of your accountant's time if the ATO audits you.

  • If you buy this insurance, and you get audited, the insurance will pay your accountant’s fees.
  • If you don’t buy the insurance, and you get audited, you will have to pay your accountant’s fees yourself.

4. Does It Mean You Must Pay for an Audit?

Only if you hire an accountant to assist you with the audit. If you handle it yourself, there’s no fee.

Bottom Line: Do You Need It?

  • If you think the risk of an audit is low, you may not need this insurance.
  • If you think an audit might happen, and you don’t want unexpected accounting fees, you might consider it.

Your accountant is not saying you must pay the ATO for an audit—only that if you hire them during an audit, you may have to pay for their time unless you have this insurance.
