I am currently going through separation and share matrimonial home.


The matrimonial home is my name only but I want to proceed with divorce as amicable as possible so I will buy out my with 50/50 split for the house.


My question is, can I rent out the home after split and the other party has been paid out? What do I need to tell ATO so that I don't get into trouble.


I have owned this house for 15 years and is currently mortgaged.

It's up to you if you want to rent your property. You'll need a valuation when you start using it as a rental. This valuation will be used to work out your capital gain or loss if you decide to sell later on down the track.


Another thing to be aware of, is you need to declare your rental income. You may be able to claim some expenses as well.


The info you report in your tax return, is how you let us know about your situation. As long as you report accurately and keep good records, you won't get into any trouble. We're also here to help if you're not sure.
