My Daughter was employed in a small business and has since left due to non payment of super. She lodged a complaint with the ATO which was dismissed as the business was not registered. She has searched her "MyGov" and has also discovered that the business also didn't pay any tax to the ATO although she has payslips saying that tax was paid. The owner of the business doesn't want to talk and has replaced my daughter with another person. A work colleague ha also approached the owner regarding non payment of Super and is now experiencing a hostile environment and now looking for another job.

The owner of the business has numerous business names in her name which all seem to have been closed.

Who does my daughter report this to is it the ATO or a Police matter?

I'm so sorry this has happened to your daughter! It's not a police matter, though.


The Fair Work Ombudsman protects workers' rights, payslips, payment of the Award rates and other entitlements.


The ATO is responsible for the tax and super obligations that employers face. Employers are obliged to register for PAYG withholding. Employers are also required to report employee tax, super and payment details to the ATO each time they pay their employees, via Single Touch Payroll.

So does that mean she has to go to the Fair Work Ombudsman and the ATO to report the issue? If so do you have a recommended starting point?
